CapEquity Finance & Consulting (‘CapEquity’) is an independently owned financial services & business consulting company. We assist in finding the best finance solution to meet your individual or business needs and are committed to saving you time, effort, and money.
We are an accredited partner of Consolidated Platform Group & PLAN Australia and have access to thousands of loan products from our panel of more than 60 bank and non-bank lenders across Australia.
We are a Credit Assistance Provider, which means that we will help you to choose a loan or lease which is suitable for your purposes, based on the information you tell us. We can provide you with information on a broad range of financiers and products, comparing fees, charges, and loan features. Once you have chosen a loan or lease that is suitable for you or your business, we will help you to obtain an approval.
Our business consulting services can assist you at all the various stages of the business lifecycle, from preparing business plans and cashflow models at the start of a business, identifying strategic investment opportunities during the growth phase, or valuing your business when it comes time to sell.

Respecting your privacy
Personal information is any information about you that identifies you, or from which you are reasonably identifiable. Your personal information will always be handled in accordance with this Policy, and the Commonwealth Privacy Act 1998.
We respect your information (personal, credit, or other), and this Policy explains how we collect and protect it, the purposes for which we use it, and to whom this information is disclosed.
Your credit information is the information we obtain, collect, or generate in connection to a loan application, including conduct on existing or previous loan facilities.
What personal, credit & other information do we collect and hold?
The types of information that we collect and hold about you could include, but are not limited to:

information such as your name, previous name(s), current & previous residential, business & postal address(es), email address(es), telephone number(s), drivers licence number, medicare number, passport number, date of birth, marital status, details of any dependants you have, your current and previous employment details;

copies of your ID documents, bank statements, share certificates, trust deeds;

other contact details such as social media handles;

financial details such as your tax file number, your tax returns, your business’s financials, your bank account details, your living expenses, any debts you currently have etc;

your repayment history for loans we have arranged on your behalf, or through others;

information that we obtain from credit reporting agencies such as your credit score, the outcome of recent credit enquiries etc;

When the law authorises or requires us to collect information
Some of the information we collect about you is required or authorised by law. For example, we require various items (ID etc) in order to verify your identity under the Australian Anti-Money Laundering/ Counter Terrorism Act.
What information do we collect via your website activity?
If you’re an internet customer of ours, we may monitor your use of internet services to ensure we can verify you and can receive information from us, and to identify ways we can improve our services for you.
If you start but don’t submit an online application, we can contact you using any of the contact details you’ve supplied to offer help completing it. The information in applications will be kept temporarily and then destroyed in due course if the application is not completed.
We also know that some customers like to engage with us through social media channels. We may collect information about you when you interact with us through these channels. However, for all confidential matters, we’ll ensure we interact with you via a secure forum.
To improve our services and products, we sometimes collect de-identified information from web users. That information could include your IP address, your geographical location, the type of operating system you are using, the pages you viewed etc.
How do we collect and protect your information?

Unless it’s unreasonable or impracticable, we will try to collect personal information directly from you. There are a number of ways in which we may seek information from you. We might collect your information when you fill out a form with us, when you’ve given us a call, used our website, uploaded documents & information into our portal etc. We also find using electronic means, such as email or SMS, a convenient way to communicate with you and to verify your details.
How we collect your information from other sources
Sometimes, we will collect personal and credit information about you from other sources. We will do this only if it’s reasonably necessary to do so, or if we need to verify the information you have given us, for example:

How we collect and hold your credit information
We will collect your credit information in the course of you answering the enquiries we make of you relating to the credit assistance you seek from us. In addition to what we say above about collecting information from other sources, other main sources for collecting credit information are:

your co-loan applicants or co-borrowers

your guarantors/proposed guarantors

your employer, accountant, real estate agent, financial planner, legal adviser or other referees

your agents and other representatives like the person who referred your business to us, your solicitors, conveyancers, and settlement agents

organisations that help us to process credit applications

organisations that check the security you are offering such as valuers

bodies that issue identification documents to help us check your identity

our service providers involved in helping us to process any application you make for credit through us
What do we do when we get information we didn’t ask for?
Sometimes, people share information with us we haven’t sought out. Where we receive unsolicited personal information about you, we will check whether that information is reasonably necessary for our functions or activities. If it is, we’ll handle this information the same way we do with other information we seek from you. If not, we’ll ensure we do the right thing and safely destroy or de-identify it.
What do we do with government-related identifiers?
In the process of collecting your information, we may be provided with government-related identifiers such as your tax file number. We will not knowingly use or disclose this information to any third party unless we are required by law.
How do we protect your information?
We store information in different ways, including paper and digital format. The security of your information is very important to us and we take all reasonable steps to protect it from misuse, interference, and loss, and from unauthorised access, modification or disclosure. Some of the ways we do this are:

secure digital document storage & transfer procedures. Our files are encrypted at rest & transfer. Our document portal is protected with bank-level security standards which are SOC 2 Type 2 compliant, with 256-bit encryption when information is at rest & during transfer.

security measures (using two-factor or biometric authentication where possible) for access to our digital systems

limiting access to information to an individual or business who is authorised to be able to receive that information (such as banks)
We may store information physically or electronically with third party data storage providers. Where we do this, we use contractual arrangements to ensure those providers take appropriate measures to protect that information.
What happens when we no longer need your information?
We may be required to keep some of your information for certain periods of time under law (in most cases 7 years). When we no longer require your information, we’ll ensure that your information is securely destroyed or de-identified in due course.
How we use your information
What are the main reasons we collect, hold, and use your information?
Collecting your information allows us to:

give you updates about any loans we have arranged on your behalf, such as reminders on end dates, annual repayments, residuals etc

consider whether you are eligible for a loan or lease or any related service you requested including identifying or verifying you or your authority to act on behalf of a customer

administer services we provide, for example, to answer requests or deal with complaints

administer payments we receive, or any payments we make, relating to your loan or lease

tell you about our other products or services that may be of interest to you

register payment defaults, in the case of your non-payment of our invoices issued for the services we have provided. This may be registered against you personally, even if the invoice relates to a business transaction

identify opportunities to improve our service to you

allow us to run our business efficiently and perform general administrative tasks

prevent or investigate any fraud or crime or any suspected fraud or crime

as required by law, regulation or codes that bind us

if you are a selling an asset to one of our clients, we will use your information to verify that you own & have the legal right to sell that asset, and disclose your details to the lender, so that they can make payment to you on behalf of our client

Can we use your information for marketing our products and services?
We may use your personal information to let you know about other products or services we make available that may be of interest to you. We won’t ever sell your information to any external organisation.
You can let us know at any time if you no longer wish to receive direct marketing or communications about our services from us.
Who do we share your information with?

We may use and share your information with other organisations for the limited purposes described above.
We may share your information with the below parties, to the limited extent that they need in order to complete their independent services:

government or regulatory bodies (including ASIC and the Australian Taxation Office) as required or authorised by law

guarantors and prospective guarantors of your loan or lease

service providers, agents, contractors and advisers that assist us to conduct our business for purposes including, without limitation, storing or analysing information

any organisation that wishes to take an interest in our business or assets

any third party to which you consent to us sharing your information, either verbally or in writing
Disclosure to credit reporting bodies
We may disclose the following information about you to credit reporting agencies:

ID information such as your name, postal or email address, telephone numbers, drivers licence number, and date of birth

details of you defaulting on a payment owed to us for the services we have provided you with

you having paid any amount previously reported as being in default

Sharing outside of Australia
We are not likely to disclose your information to organisations overseas. However, we may store your information in cloud or other types of networked or electronic storage. As electronic or networked storage can be accessed from various countries via an internet connection, it’s not always practicable to know in which country your information may be held.
How do you access your information?
We‘ll always give you access to your information unless there are certain legal reasons why we can’t. You can ask us in writing to access the information that we hold about you. In some cases, we may be able to deal with your request over the phone.
We will give you access to your information in the form you want it, where it’s reasonable and practical. We may charge you a small fee to cover our costs when giving you access.
We’re not always required to give you access to your personal information. Some of the situations where we don’t have to give you access include when:

we believe there is a threat to life or public safety

there is an unreasonable impact on other individuals

the request is frivolous

the information wouldn’t be ordinarily accessible because of legal proceedings

If we can’t provide your information in the way you’ve requested, we will tell you why in writing.
How do you correct your personal information?
How we correct your information
Contact us if you think there is something wrong with the information we hold about you. If we are satisfied that the information is inaccurate, out-of-date, incomplete, irrelevant or misleading, we will take reasonable steps to correct the information within 30 days of your request, or another period we agree with you in writing. In considering your request, we may need to consult with a credit reporting agency or other credit provider that holds or held the relevant information about you. If we correct your information we will confirm this in writing (and we will also notify any credit reporting body or credit provider with whom we have consulted in relation to the correction). If we are not satisfied that a correction is required, or we are not able to assist you, we will confirm this in writing and explain why.
We will also take reasonable steps to correct information independently of any request from you, if we are satisfied that, having regard to the purpose for which it is held, the information is inaccurate, out-of-date, incomplete, misleading or irrelevant.
Helping you manage corrections
Whether we made the mistake or someone else made it, we are required to help you ask for the information to be corrected. So we can do this, we might need to talk to others. However, the most efficient way for you to make a correction request is to send it to the organisation which made the mistake.
Please note that you can contact credit reporting agencies directly to request that they do not use or disclose credit information about you if you believe you have been or are likely to be a victim of identity theft.
Where we can’t correct information
If we’re unable to correct your information, we’ll explain why in writing within five business days of making this decision. If you have any concerns, you can make a complaint.
